Maxwell V. Pritt

Max is the leader of Boies Schiller Flexner’s California offices.  He is an experienced litigator who tries high-stakes cases for plaintiffs and defendants, and he has secured significant victories in antitrust and unfair competition, trade secret, copyright infringement, civil rights, constitutional, and other disputes, including a complete defense verdict in a billion-dollar antitrust class action against a leading technology company after he discovered the class representatives lacked standing, leading to their unprecedented dismissal midtrial.

Currently, Max is interim lead counsel for a putative class of authors against Meta Platforms for copyright infringement in connection with its generative AI models and products. He is also co-lead counsel for putative classes of authors, artists, and programmers in cases involving generative AI against OpenAI, Microsoft, GitHub, Stability AI, and others.

Max is a member of the Judicial Council of California, which is responsible for ensuring the consistent, independent, impartial, and accessible administration of justice in California.  Max is also an Appellate Lawyer Representative for the U.S. Court of Appeals for the Ninth Circuit and Chair Emeritus of the Bay Area Lawyer Chapter of the American Constitution Society. Max previously taught at Stanford Law School and UC Hastings College of the Law, and he regularly presents on constitutional and intellectual property litigation, trial and appellate practice, and impact litigation for legal industry and educational groups. After graduating law school, Max clerked for Ninth Circuit Chief Judge Mary Murguia and Judge Marsha Berzon.
